Position Context:

Negotiate provisions of research related contracts at the request of Research Services officers, whenever legal or business expertise is required;
Advise Research units on matters of policy (IP, copyright, ethics, research data and privacy, investigation of research misconduct, etc.), including training of VPRI personnel as required.
Support policy and guideline development in accordance with granting agencies and institutional requirements, through articulation of issues and principles, and drafting, as required.
Interpret contract law as it applies to University policies and regulations related to research.
Investigate, conduct research and provide advice and counsel on a variety of legal, corporate, commercial and contractual issues.
Analyze the scope and complexities of legal issues; identify and mitigate risks to the legal rights of the University and guard against associated legal risk; articulate alternatives and recommend solutions.
Provide legal advice and professional guidance to researchers and existing or potential partners within assigned areas/sectors of responsibility as it relates to research contracts and agreements.
Monitor, interpret and propose measures meant to implement existing and emerging legislation related to compliance (such as, but not limited to, legislation governing the protection of personal information) and applicable federal and provincial government guidelines (such as, but not limited to, the National Security Guidelines for Research Partnerships) and support the assessment of operational impacts by relevant units.
Education and Experience:
B.C.L.
Member of the Bar of Quebec.
Five (5) years' - Seven (7) years' related experience
Experience in commercial and contractual law, ideally with a focus on intellectual property rights and protection of personal information, with negotiating and drafting experience.
Experience in the higher education sector will be an asset.

Votre profil
Exigences
Détenir un diplôme universitaire de premier cycle (BAC) en droit.
Être membre du Barreau du Québec.
Posséder un minimum de 3 à 6 ans d'expérience pertinente en droit commercial ou droit des affaires.

Exigences
Détenir un diplôme universitaire de premier cycle (BAC) en droit.
Être membre du Barreau du Québec.

The Counsel, Litigation is responsible for handling Canadian litigation matters at CN pertaining to property damage, personal injury, commercial, employment, and some regulatory. The position provides oversight and direction to outside counsel regarding litigated claims as well as leads a group of Claims Agents who handle third party claims and is responsible for developing and executing strategies for that group.
Main Responsibilities Canadian Litigation
Oversee all litigation within the portfolio
Hire and liaise with outside counsel to defend CN
Collaborate with, provide legal and strategic advice and direction to outside counsel
Work closely with internal clients to develop strong defence strategies and advance case theories
React quickly and appropriately to major incidents that may result in substantial claims, including aiding in investigation and ensuring correct preservation of evidence
Participate in mediation and facilitation sessions
Provide thorough analysis regarding potential liability and exposure and set appropriate accruals
Working Conditions
The role has standard working conditions in an office environment on Monday, Tuesday, and Thursday (days and number of days are subject to change). The incumbent must be available to work overtime hours and weekends when necessary. Due to the nature of the role, the incumbent must be able to meet tight deadlines, handle pressure, and stress. The role requires minimal travel (5%) across Canada to visit incident sites and meet with outside counsel. The role requires being available on-call 24/7 to respond to critical incidences.
Requirements Experience
Minimum 8 years of relevant litigation experience as in-house or external counsel
Demonstrated experience as a skilled negotiator
Experience working in the transportation, trucking, or railroad industry*
Both common law and civil law experience*
Any experience for these above would be considered as an asset
Education/Certification/Designation
Bachelor’s Degree in Law (LLB) or Juris Doctor (JD)
Member of good standing of a provincial Law Society, preferably Quebec and/or Ontario
