Reporting to the AVP Claims Litigation Services, handles assigned P&C insurance legal matters, represents TD Insurance or its policyholders in civil litigation and no fault/accident benefits matters involving claims for monetary damages or compensation for personal injury or property damage.

Job Description:
Reporting to the AVP Claims Litigation Services, handles assigned P&C insurance legal matters, represents TD Insurance or its policyholders in civil litigation and no fault/accident benefits matters involving claims for monetary damages or compensation for personal injury or property damage.
Main Responsibilities
Develops and revises appropriate legal strategy for discovery, investigation, handling and trial/hearing of cases or matters; advises, communicates and develops those strategies with TD Insurance claims representatives and insured clients, as appropriate.
Conducts necessary and appropriate discovery, hearings, trials, oral arguments, settlement negotiations, mediations, arbitrations and similar proceedings. Researches the law applicable to cases or matters. Drafts legal documents, pleadings, motions, legal factums and opinions as required.

Job Requirements
Completion of law school with LLB or JD and admission to the Bar in Ontario.

Job Description
The Counsel, Incidents & Investigations role is a member of TD Legal and reports into the AVP for Privacy, Data, Cyber, Fraud & Investigations. The role is expected to anticipate legal, regulatory, economic and reputational risk, and provide strategic and practical legal advice to incident management teams, investigation units, control partners and other business stakeholders on a wide range of incidents and investigations. Triaging incidents and investigations for the investigations and cyber legal teams, including acting as TD Legal's main point of contact for the enterprise incident management team

Job Requirements
Law degree from an accredited law school and qualified to practice law in Canada

Accountabilities:
Review new file assignments and draft initial pleadings and prepare discovery
Prepare for and attend at case conferences, arbitration, discovery, mediations, pre-trials and trials
Perform due diligence; gather all relevant facts and documents; collaborate with law clerks, paralegals and/or other lawyers is assessment of file;
Research and determine applicable and pertinent laws, statutes, regulations, rules, and other legal authority; identify legal issues;
Monitor and review new laws, regulations, and case law; identify and summarize relevant issues; Collaborate with other areas of Law & Regulation department; proactively provide advice and counsel to business unit on the impact of new laws on business;
Provide advice and/or legal approval related to company documents, policy, practices, and procedures
Draft, review and/or negotiate basic matters
Draft and/or review routine correspondence and communications
Respond to claims inquires
Gather facts from client to understand goals and objectives client intends to achieve from action
Work with business colleagues to develop and implement change
Determine if/how business processes/practices need to be modified and work with client to implement change
Qualifications:
Possesses a Law Degree and is a member of the Law Society of Alberta in good standing.
Minimum 7 years’ experience. Experience in insurance defence preferred
Personal Injury experience is essential
Experience with issue management, oral advocacy and trial experience an asset
Ability to influence others
Possesses analytical skills, utilizing knowledge of the law for sound decision-making
Excellent technical, drafting, reporting, and research skills are required.
Ability to work independently and as part of a team
Exercises discretion and maintains confidentiality of sensitive information
Computer skills including MS Office Suite
Ability to interact well with all levels of the organization
