About Air Canada's HRHO

Key Functions and Accountability:
Review and assess the allegations and determine the scope of the investigation. Schedule and conduct in-person and/or virtual interviews, as appropriate.
Collect relevant evidence that is in line with the scope of the investigation from all sources, and ability to assess the evidence.
Responsible for professionally drafting, detailed, clear, and concise investigation reports in line with the HRHO directives, federal legislation, and Air Canada policies.
Responsible for including in the investigation report credibility assessments, factual and policy analyses, conclusions, and recommendations to eliminate or reduce the risk of occurrences of harassment and/or violence in the workplace.
Responsible for the investigation from start to finish, including the findings noted in the investigation report, and accountable for providing substantiated and concise documentation for each case file that is clear and properly representative of the facts and can be easily used by all decision makers.
Have oversight of the investigation process, including any legal requirement covered under said process. This may include meetings, interviews with participants (including the principal parties, responding parties and witnesses) and preparing any necessary documentation needed for the investigation process to be properly followed.
Knowledge of relevant notions in law and the ability to research jurisprudence and include, where appropriate, in the investigation report.
Participate and testify in legal proceedings, as required.
Work with local management following the completion of an investigation, to obtain updates of the parties and conduct a follow-up regarding the implementation of recommendations made in the investigative report.
Provide guidance to managers and other stakeholders as required on issues of misconduct and other related concerns.
Provide coaching, training, guidance, and expertise to employees (unionized and/or management), on information contained in applicable workplace policies, and on specific issues related to harassment and violence, and workplace misconduct.
Provide guidance and education to various departments, such as legal, labour relations, human resources, and corporate safety, including health and safety and policy committees, on topics related to harassment and violence in the workplace, and workplace misconduct.
Develop, contribute, and participate in appropriate work-related initiatives that promote a work environment free of harassment and violence, and bring awareness about the HRHO's role.
Collaborate with applicable parties to make recommendations and implement reasonable supportive measures in the resolution of notices of occurrence.
Deliver presentations, training and other educational programming to local management and employees.
Participate in the collection of data and in the build of robust case files in preparation for reports, presentations, and other publications required by law.
Maintain a high level of cultural competence, overall responsiveness, attention to detail, and the ability to exercise excellent and unbiased judgment and reasoning, free from any conflict of interest.
Continuously identify and integrate best practices in related regulatory investigation fields.
Perform special projects and other duties, as assigned.
Qualifications
A minimum of five (5) years experience in conducting investigations, preferably on harassment and violence.
Successful completion of a Diploma of College Studies (DES), an undergraduate or Master's degree at a Canadian university in Law, Labour Relations, Industrial Relations, Social Sciences, Psychology, Human Resource Management, or a related field.
Proficient in both English and French (oral and written).
Strong grasp of rules of evidence, fact-finding, and analytical/ evidence assessment skills.
Ability to synthesise large quantities of information and identify relevant information and facts; impeccably detail oriented.
Ability to prepare detailed, clear, and concise reports.
Excellent interpersonal skills and written and verbal communication skills; strong client management skills and service oriented.
Ability to prioritize competing demands and deadlines in a fast-paced environment.

Essential Responsibilities:
Develop in-depth knowledge of AECL’S mandate and missions as well as the underlying agreements from which legal issues, or the need for legal advice, may arise. This includes the agreements relating to the GoCo model and historic agreements involving AECL.
Support the Contract Management function on the interpretation, compliance and documentation of the GoCo model agreements as well as procurement activities in support of AECL operations. Required Skills, Experience and Qualifications:

Required Skills, Experience and Qualifications:
Degree in law (LLB / JD) and called to the bar in Ontario or a member in good standing of a recognized law society / bar association in Canada with the ability to work as in-house counsel in Ontario.
5-10 years legal experience, including a mix of private practice and in-house experience.

Reporting to the Director, Employee Engagement Communications and Labour relations, the Labour & Employment Counsel provides legal advice and consultation services, support, and leadership to Toronto Hydro and its subsidiaries on all matters relating to Labour and Employee Relations. The incumbent also acts as a subject matter expert relating to the interpretation and application of Toronto Hydro’s Collective Agreements, and assists with arbitration and grievance preparation, policy development and implementation, and preparation for contract negotiations.

Requirements

Position Summary
The Legal Counsel will provide legal advice and services in the general areas of corporate and commercial law, with the ability to coordinate litigation matters and provide reasonable instructions to outside counsel.

Reporting to the General Counsel and Director, Corporate and O&M, the Legal Counsel will be a key member of the Legal Team in Canada. The Legal Counsel will provide support for the company’s established and growing Operations and Maintenance (O&M) business, servicing utility-scale solar energy and energy storage projects in Canada, the U.S., and globally. The role will focus on O&M contracting, subcontracting, and warranty matters, and will also include a variety of other matters to support Canada Operations and the NASDAQ-listed parent company, Canadian Solar Inc. The ideal candidate will be a strong technical lawyer and a pragmatic businessperson.
Position Summary
The Legal Counsel will provide legal advice and services in the general areas of corporate and commercial law, with the ability to coordinate litigation matters and provide reasonable instructions to outside counsel.
In particular, the Legal Counsel will:
Provide legal support for the company’s O&M activities, which includes drafting and negotiating O&M agreements, corresponding with stakeholders, and supporting due diligence efforts in its M&A activities as the O&M business grows
Provide legal support for Canada Operations, which includes advising Finance, Tax, and IT Departments, and litigation management
Review regional contract documents for compliance with global legal framework requirements
Assist with various corporate and governance matters
Interface with middle- and top-level management
Source, create, and implement solutions for the efficient provision of legal services to various internal clients
Ensure that all activities are performed with the highest ethical standards and in compliance with Canadian Solar policies, codes, and procedures
Qualifications & Experience
The ideal Legal Counsel will have the following qualifications and experience:
D./LL.B. from a reputable law school
License to practice law in Ontario or other Canadian jurisdiction (or ability to qualify)
5-10 years of legal experience at a law firm or equivalent in-house experience
Demonstrated experience with the negotiation and drafting of services and supply agreements, and security arrangements (bonds, letters of credit, guarantees)
Ability to assist in due diligence efforts and M&A activities
Familiarity with energy project agreements and joint venture agreements preferred
Litigation management experience preferred
Strong experience with contractual matters generally, understanding of the nuances associated with drafting complicated agreements, ability to manage and navigate the challenges of negotiating complex arrangements
Experience with corporate governance rules, policies, and procedures
Demonstrated ability to provide sound legal advice, exercise good business judgment and work with senior management, outside counsel, customers, and regulators

Reporting to the City Solicitor and General Counsel, as the Director of Law you will contribute to the strategic direction of the corporation as an integral member of both the Law, Legislative Services and Security Department and The City’s Senior Management Team. Through the leadership of a diverse team of legal, risk management and claims professionals, you will focus on the implementation and oversight of efficient, comprehensive and cost-effective service delivery. Primary responsibilities include:
Lead, coach and enable a high performing team of legal, risk management and claims professionals through the establishment of a proactive, productive and positive work environment
Inspire, influence and lead change while building strategic relationships
Provide and facilitate general legal advice on litigation and insurance-related matters, property law and development, procurement law, administrative law and corporate commercial law.
Lead the handling of sensitive legal files, inclusive of coaching, directing and influencing appropriate outcomes
Support City Council, Committee and Executive Leadership Team as required
Ensure quality of work on all legal, insurance and claims matters by fostering r an environment of trust that prioritizes continuous learning, improvement, collaboration and partnerships
Contribute to corporate strategy and decisions through participation on cross corporate committees and teams.
Provide strategic leadership to the Law Leadership Team including employee engagement, technology improvements, and workforce planning/capabilities.
Collaborate with leaders across the corporation to identify and address service needs, while building comprehensive partnerships.
Oversee preparation of the Business Unit service plan and budget in accordance with corporate guidelines, including development/refinement of key performance indicators, with an eye to trends and sensitivities in a complex political environment.
Lead the Law Business Unit with a focus on equity, diversity, inclusion, anti-racism and reconciliation within a safe workplace.
Qualifications
Juris Doctor (J.D.), Bachelor of Laws (LL.B.) or equivalent Degree from a recognized institution and be an active member in good standing with the Law Society of Alberta.
Comprehensive working knowledge of the Municipal Government Act (or equivalent Act).
At least 15 years practicing law, including at least 10 years of experience practicing municipal law and working with Elected Officials.
Experience leading medium to large, diverse teams with a demonstrated ability to inspire, influence, and lead change while building strategic relationships.
Experience and/or working knowledge of civil litigation, property law and development, procurement law, administrative law and general corporate commercial law.
