ONA is seeking to hire a Contract Labour Relations Officer (WSIB Appeals Specialist) . This position reports to the Manager, Provincial Services and works within the boundaries of ONA’s governing and administrative policies, vision and strategic outcomes and team standards. The successful candidate will be responsible to meet the service delivery needs of membership by assessing WSIB files for merit and conducting appeals on behalf of ONA members.

Conduct WSIB appeals from the intent to appeal, through the investigation of the issues, writing submissions, and performing oral hearings, up to and including Workplace Safety and Insurance Appeals Tribunal (WSIAT).
Effective case management which includes performing quality merit assessments, the identification of issues in dispute, early intervention strategies and opportunities, address competing priorities among files, maintain timelines, and advance files in a timely manner.
Provide strategic advice to members regarding their appeal.
Identify and communicate trends observed in workplace injuries among ONA members – as well as the appeals process – in the areas of health and safety, return to work and labour relations to the appropriate teams to ensure members’ rights are protected.
Keep abreast of any WSIB/WSIAT and Ontario Human Rights Code legislative and policy changes that impact ONA members’ appeals.

What we are looking for:
The successful candidate will possess -
Degree or diploma in Labour/Industrial Relations (or related field).
A minimum of three (3) years of experience performing WSIB case work, along with a minimum of three (3) years of experience in adjudication and case/claims management based on interpretation of relevant statutes and principles, preferably in the WSIB environment.
Paralegal license (Ontario) is considered an asset.
A Registered Nurse designation, or other regulated health professional designation, is an asset (or equivalent combination of education and experience may be considered).

This role is based out of CNL’s Chalk River site, however the primary work location will be remote. Function and purpose
Reporting to the General Counsel, the Staff Lawyer provides legal advice and advocacy regarding the administration of the provincial collective agreement and local collective agreement language. The Staff Lawyer advises staff and local union officers on aspects of collective agreement enforcement and collective bargaining. The Staff Lawyer also provides legal advice on interpretation of legislative provisions and the terms and conditions of employment for teachers.
The position includes appearing as counsel before arbitration panels, the Labour Relations Board, Human Rights Tribunal, the Teacher Regulation Branch, other administrative tribunals and in court; providing legal advice to Field Service Division staff and locals; conducting grievance assessments; providing legal advice during contract negotiations; providing legal advice to the BCTF on other issues as needed; conducting legal research and drafting submissions; and providing training programs for staff and local officers.
Principal duties and responsibilities
Provides legal advice to the Federation and its locals, including advice on the terms of teachers' employment, matters arising from employment and/or membership in the union, the collective bargaining relationship and related matters, school district harassment investigations, privacy issues, and other issues as required.
Conducts assessment of grievances; determines in consultation with field staff the disposition of grievances.
Acts as counsel for the union in arbitrations, Labour Relations Board, Human Rights Tribunal, and other administrative proceedings.
Acts as counsel for the union in court proceedings.
Acts as counsel for members in Teacher Regulation Branch cases.
Analyses and interprets legislation.
Trains or assists in the training of officers, staff, and local leaders; organizes and/or prepares and presents a variety of workshops on labour relations and related topics.
Administration of legal advice, assistance, and legal aid to members in accordance with procedure 19.04 of the BCTF Members' Guide as specified by General Counsel.
Works with and provides instruction to outside counsel as required.
Delegates work to and oversees the work of the division's Paralegal staff.
Other duties and responsibilities
Provides analysis of grievances and grievance-related issues, including for addition to the grievance database.
Represents BCTF to external committees, agencies, and organizations as assigned.
Prepares detailed reports and recommendations on labour relations issues; writes articles and briefs.
Responsible for other legal duties and BCTF initiatives as assigned.
Required qualifications
Education
Successful completion of a Bachelor of Laws (LLB) or Juris Doctor (JD).
Successful completion of bar admissions and status as a current practicing member of a law society in a Canadian province or territory.
Experience
Minimum of two (2) years recent experience practicing labour law or five (5) years recent experience practicing in another field of law that includes barrister work.
Experience in interviewing witnesses.
Experience conducting legal research and drafting submissions to labour arbitrators, administrative tribunals, and/or the courts.
Experience appearing as counsel before labour arbitrators, administrative tribunals, and/or the courts, including examination of witnesses.
Experience acting as counsel in settlement negotiations and appearing as counsel in mediations.
Skills and abilities

Key Functions and Accountability:
Review and assess the allegations and determine the scope of the investigation. Schedule and conduct in-person and/or virtual interviews, as appropriate.
Collect relevant evidence that is in line with the scope of the investigation from all sources, and ability to assess the evidence.
Responsible for professionally drafting, detailed, clear, and concise investigation reports in line with the HRHO directives, federal legislation, and Air Canada policies.
Responsible for including in the investigation report credibility assessments, factual and policy analyses, conclusions, and recommendations to eliminate or reduce the risk of occurrences of harassment and/or violence in the workplace.
Responsible for the investigation from start to finish, including the findings noted in the investigation report, and accountable for providing substantiated and concise documentation for each case file that is clear and properly representative of the facts and can be easily used by all decision makers.
Have oversight of the investigation process, including any legal requirement covered under said process. This may include meetings, interviews with participants (including the principal parties, responding parties and witnesses) and preparing any necessary documentation needed for the investigation process to be properly followed.
Knowledge of relevant notions in law and the ability to research jurisprudence and include, where appropriate, in the investigation report.
Participate and testify in legal proceedings, as required.
Work with local management following the completion of an investigation, to obtain updates of the parties and conduct a follow-up regarding the implementation of recommendations made in the investigative report.
Provide guidance to managers and other stakeholders as required on issues of misconduct and other related concerns.
Provide coaching, training, guidance, and expertise to employees (unionized and/or management), on information contained in applicable workplace policies, and on specific issues related to harassment and violence, and workplace misconduct.
Provide guidance and education to various departments, such as legal, labour relations, human resources, and corporate safety, including health and safety and policy committees, on topics related to harassment and violence in the workplace, and workplace misconduct.
Develop, contribute, and participate in appropriate work-related initiatives that promote a work environment free of harassment and violence, and bring awareness about the HRHO's role.
Collaborate with applicable parties to make recommendations and implement reasonable supportive measures in the resolution of notices of occurrence.
Deliver presentations, training and other educational programming to local management and employees.
Participate in the collection of data and in the build of robust case files in preparation for reports, presentations, and other publications required by law.

Qualifications
