As the Senior Legal Counsel, Privacy, you’ll be responsible for advising on a wide range of privacy legal matters. You will support CIBC’s Privacy Office in managing privacy related risks, including assisting with issue resolution, internal and external communications and providing privacy related guidance and advice. You’ll be reporting to the Managing Counsel, Privacy.   How you’ll succeed Legal advice - Provide proactive, responsive and innovative Canadian privacy legal advice on a wide range of issues related to privacy to mitigate potential privacy legal risks, including in respect of new business initiatives, transactions and complaints. Keep the Managing Counsel, Privacy apprised of material developments of key projects and initiatives, and propose solutions for any material issues that may pose a potential legal risk to the business and/or organization. Strategic privacy regulatory analysis - Keep apprised of developments in Canadian privacy legislation and case law, and work with the Managing Counsel, Privacy to identify and assess any impact such developments may have on CIBC, most notably in respect of upcoming provincial and federal privacy law reform. Review privacy policies and procedures, as and when required, to ensure compliance with applicable legal requirements, mitigate reputational risk, and reduce exposure to legal liability. Relationship building - Collaborate with colleagues in the CIBC Legal Department to share legal knowledge and experience, best practices and industry trends. Partner with functional groups such as the Privacy Office, Communications, Compliance, and Risk, in order to resolve legal and regulatory issues and provide subject matter expertise. Engage, after consultation with the Managing Counsel, external legal counsel and work closely with them to ensure efficiency, cost-effectiveness and a solid work product.   Who you are   You can demonstrate experience in providing Canadian privacy legal advice on complex issues and mitigating legal and reputational risk. Keep apprised of legal developments and applicable legislation and case law, bring such developments to the attention of the Vice President & Associate General Counsel, Transactions, Privacy & Law Clerks, and take a lead role in, or oversee, the identification and assessment of any impact such developments may have on CIBC. Judgment & collaboration - Work in close collaboration with colleagues in the Legal Department, as appropriate, to execute complex and time-sensitive projects. Partner with executives and senior management of the business and members of other functional groups and lines of business in order to provide legal and related transactional support for CIBC’s strategic initiatives, including those led by the bank’s Corporate Development group. Work closely with external legal counsel for specific material assignments. Business mindset - Review, draft, and negotiate complex and sensitive legal documents and discuss material issues with the Vice President & Associate General Counsel, Transactions, Privacy & Law Clerks, as applicable. Use strong judgment and know when to escalate material legal and/or reputational issues in a timely manner. The Managing Counsel role at CIBC leads a team of legal professionals accountable for providing a wide range of legal services and advice to business and functional leaders across the organization. Utilizing strong independent judgment, broad-based legal knowledge, and a high level of professionalism, the Personal Banking legal team proactively works with employees at all levels in designated lines of business focused on Retail products as well as functional teams impacted by a regulatory framework. The Personal Banking legal team are experts in understanding and delivering proactive legal and regulatory advice to Canadian Retail banking to assist in the development and delivery of products and services as well as provide solution oriented advice to mitigate risk. The Managing Counsel also provides legal expertise to executive and senior leadership on complex and/or sensitive issues in both the project context and in unique situations.   How you’ll succeed Legal advice & counsel – Provide proactive, responsive legal advice grounded in the Bank Act and consumer protection laws and Codes of Conduct on complex issues primarily to related to CIBC’s Canadian retail banking business units to assist with the identification and mitigation of legal, regulatory and reputational risk in both end to end projects as well as on unique situations. You will keep apprised of developments in Bank Act and relevant consumer protection laws, regulations and case law and take a lead role in the identification and assessment of any impacts such developments may have on CIBC including working with industry associations as appropriate. You will identify frameworks for analysis, work closing with CIBC’s lines of business from product and service development to execution; collaborate on regulatory developments and proactively resolve legal issues that may have significant organizational implications and prepare practical recommendations to assist CIBC in addressing the identified issues. People management & leadership – Lead the performance, development and professional growth of lawyers in a manner that enables Canada Legal to deliver its value proposition to be professional partners, proactive counselors and knowledgeable advisors.
